3 of 4 cops not liable in civil police assault case

BROOKLYN - (AP) - A federal civil jury cleared three New York Cityofficers of any liability in the alleged assault of a man in asubway, but deadlocked on an excessive force claim for the fourthofficer. Michael Mineo sued the city, the NYPD and the four officersinvolved in an incident in October where he claimed he wassodomized with a police baton during an arrest. Three of the fourofficers were tried and acquitted of criminal charges in the caseearlier this year. The fourth officer was never charged. The civil jury could not decide whether Officer Richard Kern,accused of actually shoving the baton into Mineo's backside, shouldbe held liable for excessive force. Jurors found Kern liable ofmalicious abuse of criminal process but a judge set aside thedecision.
