Michael Mineo sued the city, the NYPD and the four officersinvolved in an incident in October where he claimed he wassodomized with a police baton during an arrest. Three of the fourofficers were tried and acquitted of criminal charges in the caseearlier this year. The fourth officer was never charged. The civil jury could not decide whether Officer Richard Kern, accused of actually shoving the baton into Mineo's backside, shouldbe held liable for excessive force.
