Accused officer: I didn't assault Mineo

BROOKLYN - The officer accused of assaulting a Brooklyn man took the stand at his trial Thursday.

Officer Richard Kern testified he did not assault Michael Mineo at the Prospect Park subway station.

Kern stated he chased Mineo into the subway station after he caught him smoking marijuana on Oct. 15, 2008. He says he took out his police baton in order to subdue Mineo but did not fully open the device or use it to sodomize the victim.

Kern is charged with aggravated sexual abuse and assault. Two other officers, Alex Cruz and Andrew Morales, are also accused of covering up the attack. They are charged with hindering prosecution and official misconduct.
