Brother of murdered immigrant takes the stand

BROOKLYN - The brother of murdered immigrant Jose Sucuzhanay took the stand today in the retrial of one of his accused killers.

During today's testimony, Romel Sucuzhanay fought back tears as he told the jury about how he found his brother covered in blood after the attack.

Last month, a judge declared a mistrial in Keith Phoenix's case after the jury couldn't come to a verdict.

Prosecutors say Phoenix and his friend, Hakim Scott, attacked Sucuzhanay and his brother because they thought they were gay.

Scott was convicted of manslaughter by a separate jury and faces up to 40 years in prison.
