CROWN HEIGHTS - An 86-year-old Crown Heights man is suing the city, claiming he was wrongfully hit by an NYPD stun gun.

John Antoine says he was cooking soup and chopping an onion when police stormed into his Bergen Street apartment. Police were responding to a 911 call about a 23-year-old emotionally-disturbed person.

Antoine says police used a stun gun on him. His attorney says his client should have never been mistaken for a 23-year-old.

Antoine filed a notice of claim against the city, claiming excessive force.

The NYPD says the responding sergeant showed an intelligent level of restraint that is to be commended. They went on to say, "The individual he (the sergeant) encountered inside the residence was armed with a large kitchen knife, and was in immediate proximity to both the sergeant and 3-year-old who was also present at the residence. The individual refused to comply with the sergeant's commands to drop the knife..."

Antoine says he was hit with the stun gun as he tried to put the knife down. He is facing harassment charges over the incident and is due in court next month.
