A forensic expert testifying on behalf of an NYPD officer who allegedly sodomized Michael Mineo said Thursday a hole found in the Brooklyn man's boxer

BROOKLYN - A forensic expert testifying on behalf of an NYPD officer who allegedly sodomized Michael Mineo said Thursday a hole found in the Brooklyn man's boxer shorts could not have been caused by a baton.

Nicholas Patraco's testimony was backed by another defense witness, James Dallas, an attendant at the Prospect Park train station where the attack allegedly happened. Dallas told jurors he did not see Officer Richard Kern attack Mineo, who police chased into the station after he was seen smoking marijuana on Oct. 15, 2008.

Kern is charged with aggravated sexual abuse and assault. He is on trial with two other officers, Alex Cruz and Andrew Morales, who are accused of covering up the attack. They are charged with hindering prosecution and official misconduct.

All the officers have denied any wrongdoing.
