BROOKLYN - After failing to reach a verdict in the first trial, a new jury is now deliberating in the retrial for a fatal beating that took place in Brooklyn.Keith Phoenix is charged with second-degree murder and murder as a hate crime. Prosecutors claim Phoenix and Hakim Scott attacked Jose Sucuzhanay, an Ecuadorian immigrant, and his brother because they thought the two men were gay.

If convicted, Phoenix could face up to 25 years to life in prison.

A separate jury convicted Scott of manslaughter. His sentencing is scheduled for next month.
