New York City loses final appeal on ban of large soda sales
BROOKLYN - The city lost its final appeal on limiting the sales of large sodas.
The New York State Appeals Court ruled that the Department of Health overstepped its boundaries when it restricted the size of sodas. The court is siding with a lower court that overturned the 2012 ban, which former Mayor Michael Bloomberg had originally pushed for as a way to fight obesity.
City Health Commissioner Mary Basset responded by saying, "Today's ruling does not change the fact that sugary drink consumption is a key driver of the obesity epidemic, and we will continue to look for ways to stem the twin epidemics of obesity and type 2 diabetes by seeking to limit the aggressive and predatory marketing of sugary drinks and unhealthy foods."
