A Brooklyn woman who admitted to texting while driving when she fatally struck a local restaurant owner has avoided jail time.

According to prosecutors, Nechama Rothberger rear-ended 53-year-old Tian Sheng Lin while he was waiting at a light on his scooter two years ago. Rotherberger was 19 years old at the time.

Rothberger will reportedly be on probation for five years and will serve 100 hours of community service. During that time, she'll work with a program called Choices and Consequences to warn students of the dangers of distracted driving.

Gov. Andrew Cuomo (D-NY) made texting behind the wheel a primary offense following the tragedy.
