Trial for ex-NYPD detective accused in fatal DWI under way
The trial of a former NYPD detective accused of negligently striking a pedestrian with his car in 2009 is under way at the Bronx County Supreme Courthouse.
The day was spent finalizing the jury pool that will decide whether Kevin Spellman killed Drana Nikac, 67, of The Bronx, while driving drunk. The prosecution argued during its opening statement that Spellman was under the influence of alcohol when he ran a red light and struck Nikac in October 2009. Investigators say Spellman refused a Breathalizer test at the scene of the accident.
The defense argued that Spellman's blood work, which revealed he was three times over the legal limit, was faulty.
The first witness called was the victim?s son, who wept on the stand as he described identifying his mother's body. The medical examiner was also called and described the injuries Nicak sustained in that accident.
The trial is expected to resume Thursday morning.
Spellman faces charges including vehicular manslaughter and driving while under the influence.
