A woman is seeking $10 million after getting caught in a crossfire between police and a suspect in University Heights, her attorney says.
Irene Perez's attorney says police should've handled themselves differently.
Perez and a 12-year-old girl were taken to the hospital after a police officer fired his gun at a suspect they say shot first.
Perez's attorney says Monday that they filed a notice of claim for negligence and recklessness against the NYPD and the city of New York.
The shooting happened near 183rd Street and Loring Place. Police say the suspect they were after was wearing a backpack filled with narcotics.
They also say they have video of that man shooting at others who initially had the backpack.
While gun shots were exchanged with the suspect, Perez was shot in the stomach.
Perez's attorney says she has had multiple surgeries and has severe damage to her stomach, liver and pancreas.
He also says it's unclear how much longer Perez will be in the hospital.
