A fellow officer testified Tuesday in the trial of the NYPD officer accused of using a banned chokehold in Eric Garner's 2014 death.

The officer on the stand claimed he exaggerated how many cigarettes Garner was accused of selling.

Officer Justin Damico said he filled out arrest papers accusing Garner of a felony tax charge, claiming he sold 10,000 untaxed cigarettes at the time.

Damico said there were fewer than 100 cigarettes on him.
