AG files suit against property management company for failing to comply with lead law

The New York attorney general is filing a lawsuit against a Bronx-based property management company for violations of the city's Childhood Lead Poisoning Prevention Act.

The New York attorney general is filing a lawsuit against a Bronx-based property management company for violations of the city's Childhood Lead Poisoning Prevention Act.

It's the first-ever lawsuit filed by the Office of the Attorney General for failing to comply with the lead poisoning prevention law.

Chestnut Holdings is getting slapped with the lawsuit. The company manages more than 6,000 apartments, most of which are in the Bronx.

"This landlord and his property manager failed to conduct required follow up on missing annual notices. In addition to that, the inspections that they conducted were inadequate,” says Attorney General Letitia James.
James says her office reached out multiple times to Chestnut Holdings, but did not get a response.

"When they fail to comply with the law and when they fail to respond to our letters, we have no other recourse but litigation,” says James.
James says at this point, there is no evidence of children being sick. “What we do have is the fact that the landlord, unfortunately, has not complied with the law and as a result of that, he again, it poses a threat to all of the children who are currently residents in this building,” she says.
An attorney representing Chestnut Holdings responded to this lawsuit saying the company “…has fully and completely cooperated with the Attorney General's Office in its lead paint investigation. It produced thousands of pages of documents and information, and continued to offer more evidence of compliance. Chestnut fully complies with all lead laws and addresses any lead issues immediately. The building in front of which the attorney general selected to announce the lead lawsuit, 1515 Macombs Road, has exactly zero lead violations."
