A Brooklyn man accused of killing his 3-year-old daughter in 2007 was convicted of first-degree manslaughter Friday.

The judge ruled that Jason Marcelle was guilty of delivering a fatal blow to his daughter Takai. Marcelle, however, was found not guilty of second-degree murder on the grounds that there was a lack of intent to kill on his part.

On Dec. 5, 2007, Marcelle called 911 from his Bedford-Stuyvesant apartment, saying that his daughter was unconscious. The toddler was taken to the hospital, where she was later pronounced dead. The medical examiner determined that Takai Marcelle died as a result of blunt-force trauma to her liver.

According to prosecutors, Marcelle punched his daughter because she was defecating all over their apartment at 350 Marcus Garvey Blvd.

Marcelle's defense attorney David Jacobs says he plans to appeal the manslaughter conviction, but he is pleased with the verdict.

"I'm gratified that the judge realized that the defendant did care whether his daughter lived or died," he says. "He got immediate attention for her injuries, he called 911, he gave her resuscitation."
