An elderly man is dead after getting hit by a car earlier this month.

It happened on Avenue D at East 49th Street on Oct. 2.

Police say the 71-year-old was jaywalking across Avenue D when a Gray Lexus traveling eastbound hit him.

The driver stayed at the scene and was not charged.

The elderly man was taken to the hospital where he passed away from his injuries Thursday.
