New York City lawyers say some of former NYPD Commissioner Ray Kelly's emails that were supposed to be preserved were deleted when he left office in 2013.
They say the emails should not have been deleted because of an ongoing class action suit and a court order to have them preserved.
The lawsuit accuses the police department of using a quota system for summonses.
City officials say the emails were accidentally deleted by NYPD technicians.
