A notice of claim was filed against the city after a parent says her son was bullied and beaten by a group of students.
The attorney for 14-year-old Davian Fraser at Williamsburg Charter High School says they filed a notice of claim against the Department of Education for $5.5 million.
They say the teen was bullied for weeks and then assaulted last month. Myasia Dickerson, says students started bullying her son in September of last year - after the student experienced bullying in other schools.
She says Fraser was followed and that students started recording him. She also says he was stalked from classroom to classroom and followed to the train station.
Dickerson says on Dec. 16 he was approached by a group of classmates who started beating him as he tried to escape and look for a security officer.
Fraser tried to seek refuge in another classroom, according to Dickenson, but was turned away by a teacher who had a class.
A spokesperson from Williamsburg Charter School tells News 12 it has not received any legal complaint, but says in part, "The school asserts that until the mother withdrew her son from school, WCHS made every effort to mitigate the issues her son may have been experiencing at school and at home despite his mother's unwillingness to support the processes in place."
The school also says they have policies in place that are designed to reduce bullying and harassment. Meanwhile, Fraser's attorney says the school failed him.
News 12 has reached out to the New York City Department of Education and has not heard back yet.
