Closing arguments got underway Monday for one of the men accused of killing Carey Gabay, a former aide to Gov. Andrew Cuomo.
The shooting happened in 2015, in the hours before the West Indian American Day Parade.
Lawyers painted two very different pictures of defendant 32-year-old Kenny Bazile Monday.
Prosecutors claimed he actively took part in the gang shootout that killed Gabay, while Bazile’s lawyer claimed he was only acting in self-defense.
The closing arguments came after a two-month trial, and included hours of surveillance video from Sept. 7, 2015, as shots rang out in a crowd of revelers on Bedford Avenue in Crown Heights.
Gabay was killed when he was struck by a stray bullet in the head.
The prosecution alleged Bazile and three other men, Micah Alleyne, Stanley Elianor and Keith Luncheon intentionally created a zone of violence when they opened fire. Bazile’s lawyer says he had no part of that gang war and was just trying to protect himself.
The other defendants are being tried before a separate jury.
All four men face 25 years to life in prison if convicted of murder. Meanwhile another man, Tyshawn Crawford, took a plea deal to avoid a possible life sentence in exchange for testifying against them.
