Many community members in Crown Heights are opposing new development plans they say would negatively impact the neighborhood.
Alicia Boyd is leading a lawsuit against Cornell Realty Management LLC. Back in 2018, the development firm won zoning changes that would allow 16-story buildings to be built at two locations on Franklin Avenue.
Boyd, who is with the organization "The Movement to Protect The People," filed a lawsuit against the developer and the city back in April. Boyd says a proper environmental impact study was never completed.
The developer claimed the suit wasn't properly served. However, the judge on Monday disagreeing, allowing the lawsuit to move forward.
A big concern is the impact the buildings would have on the Brooklyn Botanic Garden, limiting sunlight to the plants.
Neighbors also worry the new buildings would force residents out without rising rents.
After Monday's win, they say there's still a lot of fighting left to do. The next hearing will be on Oct. 7 in Downtown Brooklyn.
