A student was arrested for allegedly bringing an unloaded gun into Bronx Park Middle School in Allerton last week.
Classmates paint the 13-year-old as a bully, but the teen's lawyers say it's the opposite.
"The true victim in this case is this young man," says Walter Fields. "This young man has been the victim of assaults for numerous years. Just this year, he's been spit on, a gang has assaulted him, he's feared for his life." 
The seventh-grader was arrested and charged as a juvenile with criminal possession of a weapon.
"If he gets pushed and pushes back, does that make him a bully? I don't think so," says attorney Ronald Fisher. 
In a separate incident that happened on Sept. 27, police say 18-year-old Abel Cedeno stabbed two students - one to death - at a school on Mohegan Avenue. Supporters of the senior say he was viciously bullied as well.
Parents of some Bronx students are putting the blame on the city's Department of Education, saying not enough attention is given to students in distress. 
"My daughter is a middle schooler and I'm scared for my life sometimes," says parent Angelique Carrion. "Kids coming to school with guns, knives. That would be a true nightmare if that happened."
The DOE released a statement in response to the gun incident saying, "Nothing is more important than the safety of students and staff. The NYPD immediately responded and safely recovered an unloaded gun."
News 12 also asked the DOE about bullying in schools. A statement from the DOE said, "We’re investigating this serious matter and providing additional support to the school.  We take any allegations of bullying seriously, and have clear protocols and robust programs in place to ensure bullying incidents are immediately reported and swiftly investigated and addressed.”
