The U.S. Supreme Court has turned downproperty owners and tenants facing eviction to make room for a newNets arena in Brooklyn. The justices rejected an appeal that was intended to stopdevelopment of the Atlantic Yards project. Eleven property ownersand tenants said that using the government's power to take theproperty, called eminent domain, violates the Constitution becausethe project would primarily benefit the developer, not the public. Developer Bruce Ratner says he wants to build 16 skyscrapers, an18,000-seat arena for the professional basketball franchise andthousands of apartments. The area currently is occupied by a railyard, industrial buildings, and some businesses and homes. The case is Goldstein v. Pataki, 07-1247.
