Fire marshal accused of accidentally shooting himself with illegal gun is arraigned

The Brooklyn District Attorney's Office says an FDNY fire marshal has been arraigned after he allegedly shot himself in the foot with an illegal gun at the FDNY Headquarters.

James Beringer, 52, is accused of discharging the gun on March 27 while he was on duty at 9 Metrotech Center in Downtown Brooklyn.

Prosecutors say Beringer was allegedly sitting on a table in the office/computer room, just before 8 a.m., when another fire marshal, Malik Grisset, heard Beringer yell out, "I shot myself in the foot."

Authorities say EMS took Beringer to NewYork-Presbyterian Brooklyn Methodist Hospital. He is expected to recover.

According to court documents, Grisset later found a gun inside a safe in the same room. The gun lacked a serial number and contained a magazine and eight cartridges.

Prosecutors say Beringer is not licensed to carry the unregistered pistol in New York State.

He is charged with criminal possession of a firearm and criminal possession of a weapon.

Beringer is due back in court on Aug. 11.
