As the family of an off-duty officer killed in a friendly fire incident finalizes his funeral plans, the man who was allegedly burglarizing his car the night he was killed has been indicted on felony charges.

Police say Omar Edwards, of Ocean Hill, was killed while chasing Miguel Goitia, who allegedly broke into Edwards' car May 28 in Manhattan.

Edwards, who had just finished his shift and was in street clothes, had his service weapon out when police say three plainclothes officers on routine patrol yelled for the two to stop running. As Edwards turned toward them, one officer, Andrew Dunton, opened fire and hit Edwards three times, police say.

According to his lawyer, Goitia is now facing charges including petit larceny, auto stripping in the third degree and criminal mischief in the third degree. He is due back in court on June 30.

NYPD Commissioner Ray Kelly reiterated Wednesday that the department is investigating the friendly fire incident from all angles.
