An appeals court has overturned the manslaughter conviction of a Bay Ridge woman accused of smothering her newborn daughter.
Laura Sergio faced five years in prison after prosecutors say she wrapped her baby in towels and placed her in a garbage bag in 2007. Sergio claims she suffers from amnesia and remembers nothing from that day.
The 30-year-old was convicted in 2010, but the appellate panel ruled that evidence did not eliminate the possibility that someone else killed her child.
