A federal appeals court ruled Friday that Bruce Ratner's Atlantic Yards project in Brooklyn can move forward.

The 2nd Circuit Court of Appeals rejected a lawsuit brought forth by property owners and tenants facing eviction due to the $4 billion development. Opponents are challenging the use of eminent domain to seize property needed for the Atlantic Yards project.

The decision overturned a previous ruling that said the seizure of the property was unconstitutional. Critics contested the creation of a sports arena and skyscrapers as eminent domain, saying the project didn't necessarily benefit the public.

Attorney Matthew Brinckerhoff plans to appeal the decision to the U.S. Supreme Court.
