A judge is expected to decide Wednesday whether to overturn the conviction of former NYPD Officer Peter Liang after learning one of the jurors failed to disclose that his father had been convicted of manslaughter.
Michael Vargas, 62, is scheduled to face a judge today.
Liang's attorneys filed a motion seeking a new trial after Vargas told newspapers that his father had served time in prison, even though he told lawyers during the selection process that no family member had ever been convicted of a crime.
Liang is scheduled to be sentenced on Thursday.
