The NYPD said Tuesday that the shooting of a Brooklyn resident was justified, but witnesses disagree.

According to Police Commissioner Raymond Kelly, the officers involved acted accordingly when they shot Robert Ramirez in the courtyard of the Glenwood Houses Monday. Kelly says Ramirez attacked the officers with a metal scooter. Witnesses say Ramirez was only trying to help his stepfather, who they say was handcuffed to the fence and speaks limited English. But police say the stepfather pushed an officer and was holding onto the fence. A 911 tape that was released has the caller telling an operator that police officers were attacked.

Ramirez's parents, however, say police overreacted. They say the dispute should have never led to their son being hospitalized in critical condition.
