The New York Post reports that a judge in Albany is blocking the recently passed ban on broker fees.
The Post says a judge issued a temporary restraining order on a rule that renters can no longer be charged broker fees. The judge's order means that brokers can continue to collect a commission from tenants until both sides present a case in a court appearance.
The Department of State had put out the updated guidance on broker fees last week, saying when a landlord selects a broker to find a tenant and negotiate a lease, the fee is on the landlord--not the renter.
The DOS has until March 13 to respond.
