Two more men have been arrested and charged with assaulting an off-duty police officer from White Plains. Jonathon Ayala, 19, and 23-year-old Alexander Fontanez are accused of being a part of the group that beat Officer Eric Hernandez while he was on line at a White Castle in the Bronx. Following the attack, Hernandez made his way to the parking lot where he drew his weapon and pointed it at a man he thought was one of his attackers. Witnesses say when police told Hernandez to drop his weapon he turned towards them with his gun in hand. That's when Officer Alfredo Toro fired, hitting Hernandez three times. Police have already charge Nelson Rodriguez, Edwin Rivera, Daryl Massey and a 16-year-old in connection to the attack. The suspects are expected back in court on February 3.Officer Hernandez, 24, had part of his right leg amputated and remains in critical condition at Saint Barnabas Hospital.
