Testimony in the murder trial of Cesar Rodriguez continued Tuesday after the judge denied requests from defense attorneys to throw out the case.

Rodriguez is charged with beating his 7-year-old stepdaughter Nixzmary Brown to death. He could face 25 year in prison if convicted.

The proceedings were held up for nearly a week because of issues surrounding the safety of an unnamed witness. Defense attorneys argued evidence from the witness should have been turned over before the trial started and requested a mistrial.

Testimony in the trial resumed with Taylor Dickerson from the medical examiner?s office. Dickerson testified Brown?s blood and DNA were found on several items, which prosecutors say Rodriguez used to torture her.

Defense attorneys said Brown?s blood was found on Rodriguez because he tried to save her the day she was murdered.

Prosecutors said they hope to wrap up their case by next week.
