A mother whose son was hit by a car earlier this week wants the driver to be held responsible.

Police told News 12 a 36-year-old driver hit the boy near Rockaway Parkaway and Seaview Avenue then eventually crashed into a pole a few blocks away.

The driver told News 12 at the scene on the day of the crash that she did not hit the child. She remained on scene and was not charged.

The mother believes justice has not been served and has hired an attorney as she explores legal options.

Sources tell News 12 it appears the child was crossing against the light. However, his mother says that doesn't mean he was in the wrong.

Belushin Law Firm's Daniel Berger says the police report has not been issued out and that they're going to hold her accountable to the full extent of the law. He says they are seeking justice whether it's for compensatory damages or punitive damages.

Police told News 12 that the investigation continues. The attorney declined in elaborating on the extent of the child's injuries but says he is still emotionally distraught over the incident.
