Lawyers of four men indicted for illegally harvesting human tissue for transplants sought a dismissal in court Thursday.
During the pretrial hearing at State Supreme Court in Brooklyn, defense lawyers for Dr. Michael Mastromarino, Joseph Nicelli, Christopher Aldorasi and Lee Cruceta argued some of the suspects did not know their actions were illegal. They are charged with fraud and stealing body parts in a 122-count indictment. Prosecutors claim the suspects, two of whom worked at a Brooklyn funeral home, also falsified the cause of death for some donors.
Pamela Grigorian allegedly received HIV tainted tissue during surgery. Grigorian and others are upset the attorneys asked for a dismissal with so many charges against the men. The suspects are due in court again May 15.
