The Brooklyn pizza delivery man who immigration authorities detained earlier this month remains locked up in New Jersey, although he has been spared deportation for now.

As News 12 has reported, Pablo Villavicencio was delivering pizza to the Fort Hamilton Army base in Brooklyn on June 1 when guards would not accept his IDNYC card as valid identification.

They turned him over to immigration agents, who say Villavicencio had ignored a request to voluntarily leave the country in 2010.

Since then, the Legal Aid Society helped secure a stay of deportation. But he remains detained, and his wife says it's been a cruel few weeks for her and their children -- all of whom are American citizens.

"I don't even know what to tell them, but it's every day the same question," says Sandra Chica, Villavicencio's wife. "Why's daddy not with us?"

The Legal Aid Society has submitted a request for his release on the grounds that he has no prior criminal history and is not a flight risk.
