The mother of a Brooklyn boy who died from a medication-resistant strain of staph said Tuesday she plans to sue the city and one of its hospitals.
Aileen Rivera announced her $25 million notice of claim at the Manhattan office of The Cochran Firm.
She claims Kings County Hospital doctors sent her son, 12-year-old Omar Rivera, home after giving him over-the-counter allergy medicine. The I.S. 211 student died two days later on Oct. 14.
"This child should never have been released," said attorney Peter Weitz. "There should have been blood work. They should have kept him there for more tests."Rivera says when she later took Omar to the emergency room at Brookdale Hospital, the staff said they did their best, but her son died.
"That was my only child," Rivera said. "I don't have anyone else. It's only me."
A Kings County Hospital spokesperson says Rivera didn't show any signs of methicillin-resistant Staphylococcus aureus. The hospital is now examining what else could have been done to detect the infection.
