No criminal charges have been pursued for Officer Miguel Gonzalez, who shot and killed Dwayne Jeune back in 2017.
The decision was concluded after an investigation by the district attorney's office. The family's lawyer says the district attorney felt that after an intensive investigation they could not prove beyond a reasonable doubt that a crime was committed.
Jeune was shot and killed by Gonzalez in July.
Investigators say his mother called 911 for help and that Jeune charged at the police with a knife when the officers arrived.
Another officer tried to halt Jeune with a stun gun, but when that didn't work, Gonzalez shot and killed him.
The family filed a wrongful death lawsuit, alleging that the officer was not properly equipped to deal with an emotionally disturbed person.
News 12 spoke with Dwayne Jeune's father just moments before finding out the criminal charges will not be brought, "We take the decision with a lot of regrets because we are convinced and saw the police committed a criminal act. We are very saddened but we know justice will be served one way of the other. We know that one day, one day that we are going to get satisfaction," said Jeune's father.
The family's attorney says the fight for justice is not over and that they intend to proceed with the civil case in federal court for damages of wrongful death.
They also plan on asking the police department to conduct an internal probe as to whether or not the officer should be removed.
