The parents of Thaiya Spruill-Smith had been fighting for custody and were in disagreement over whether to donate her organs. Because they could not reach an agreement, the toddler's organs will not be donated by default.
According to police, the little girl was declared brain dead last week after being rushed Brookdale Hospital with a massive head injury.
Prosecutors say Thaiya's stepfather, David Adams, violently shook her. He has been charged with assault, but charges are expected to be upgraded.
