Rockland County district attorney joins investigation into ShopRite gunfire incident

The Rockland County District Attorney’s Office has joined the investigation into the gunfire incident at the Garnerville ShopRite, where an off‑duty NYPD official’s weapon discharged during a confrontation last weekend.

According to a statement from the prosecutors office, they agreed to assist Haverstraw police after evaluating the evidence including video of the alleged incident.

The video has not been publicly released.

As previously reported, News 12 learned that NYPD Assistant Chief Benjamin Gurley was allegedly involved in a fight with a man in the grocery store parking lot on Sunday night when his gun discharged once. No one was struck.

Gurley’s online NYPD profile shows he has received four awards and completed extensive training sessions over his 26‑year career. The profile also indicates he has no disciplinary history.

A law enforcement source told News 12 on Tuesday that Gurley is now on modified duty following the incident.

News 12 is working to find out whether the gun involved was city department‑issued. News 12 has also made multiple requests have been made to view the video.

We are also seeking more information about the man police say was harassing Gurley’s daughter. Investigators say that alleged harassment may have sparked the dispute that led to the gun discharging.
