It has been three years since a police officer was fatally shot in the Bronx, but the two men accused in the shooting were back in court Tuesday only to find out that the case will be delayed.
Former ?Sopranos? actor Lillo Brancato Jr. and Steven Armento are accused in the December 2005 death of Officer Daniel Enchautegui. Prosecutors claim Enchautegui, who was off duty at the time, confronted the two men as they were trying to break into a Bronx home. The officer was then shot and killed, according to prosecutors. Both men have pleaded not guilty to charges of murder, burglary and weapons possession.
In court Tuesday, it was revealed that the lead detective in the original investigation was interviewed by internal affairs. Armento?s lawyer says this new information will determine how the defendants? cases will be built. Brancato?s lawyer is hoping the two men will be tried separately.
Once the new evidence is reviewed, the defense attorneys and prosecutors will be back in court Friday to determine if they will stay in the hearing phase or go to trial.
