A popular South Shore restaurant won't be reopening for the 2026 summer season.

South Swell on the Bergen Bay Docks in West Babylon will close because of “unexpected” licensing issues despite having an approved liquor license and permission for live music.

In a social media post, the owners say the problem is related to its cabaret license and that has made it impossible for them to reopen.

The waterfront eatery claims this kind of permit has not been required by any other business in the Town of Babylon in more than 25 years.

“It is heartbreaking to lose something so deeply loved over an issue that, in our view, should never have stood in the way of serving our community,” the owners said. "We are beyond grateful for every person who walked through our doors, every sunset shared, every laugh, every celebration, and every memory made at South Swell.”

The town tells News 12 the license exists to make sure a site is actually equipped for the type of operation taking place and that a full-service bar on a dock raised several safety concerns.

They say there are tentative plans for a local coffee shop owner to take over the space as a coffee shop and deli.
