Jury selection is underway in the case against a man who prosecutors say stabbed two young children in an East New York elevator four years ago.
Daniel St. Hubert allegedly stabbed 6-year-old PJ Avitto 16 times, killing him. Then prosecutors say he turned the blade on Mikayla Capers, leaving her seriously injured. She is expected to testify during the trial.
But despite the surviving witness and DNA evidence linking St. Hubert to the scene, his lawyer says he's innocent.
"The defendant is just a patsy, and we intend to prove it," says Howard Greenberg, the defense attorney. "He's being made to take the fall for the real killer."
Greenberg also called DNA "junk science," criticized the police as lazy and called into question the witness' credibility.
"The child witness who survived is not worthy of belief," he claims. "The lineup witnesses were told who to pick by the police."
St. Hubert faces charges of murder, attempted murder, assault and more.
