A month after his sentence of life in prison was vacated, Wayne Martin was released from custody Wednesday -- but he's still not quite a free man.
A judge agreed to release him until his next court date, when he may face renewed court proceedings.
The district attorney's office says it needs more time to investigate whether Martin will face a new trial in connection with a double homicide in Brownsville 11 years ago.
He was convicted in 2010 and sentenced to life in prison without parole, but the DA's Conviction Review Unit uncovered potentially critical testimony that it says was intentionally withheld from Martin's defense team.
Martin is not allowed to leave the state as he awaits his next court appearance on Sept. 7, when he is expected to learn whether he will face a new trial or be freed for good.
