The pizza deliveryman who immigration officials detained after he tried to bring food to the Fort Hamilton Army base in Brooklyn will return to court for a deportation hearing Tuesday.
Immigration and Customs Enforcement has detained Pablo Villavicencio for more than 50 days so far. The Legal Aid Society is representing him in court in a bid to prevent the government from sending him to Ecuador.
As News 12 has reported, Villavicencio lives on Long Island and has two children and a wife who are all American citizens.
He was delivering food from a Queens restaurant to Fort Hamilton on June 1 when a guard had a problem with his city-issued identification card. The guard alerted immigration agents, who found that Villvicencio had failed to obey a voluntary agreement to leave the country in 2012.
In mid-June, a judge granted a temporary order that allowed Villavicencio to remain in the country as he appeals his deportation. Immigration advocates and even some City Council members have since demanded his release, arguing that he shouldn't be in custody to begin with.
"The Villavicencio family has done nothing wrong here," says Jennifer Williams of the Legal Aid Society. "In fact, they've done everything right. They're hardworking, they file their taxes, they raise a family, and most importantly, Pablo was pursuing a path to legalize his status for the sake of family unity."
Make the Road NY and other immigration activists plan to rally outside the federal courthouse in Manhattan Tuesday ahead of the hearing.
