Widow sues building management after husband, son killed by neighbor in East Flatbush

The video of the tragic death grabbed attention of the city two years ago.

A Brooklyn widow is suing her building management, alleging they failed to act on warning signs before her husband and son were fatally shot by a neighbor in 2023.
Marie Delille, whose family lived at Flatbush Gardens, filed a lawsuit claiming security personnel may have witnessed the shooter, Jason Pass, preparing his firearm before the attack but failed to intervene.
“Somebody behind the screen saw that before I came out of the door—someone watching Jason Pass fixing his gun,” Delille said.
Bladimy Mathurin and Mode Chinwai were shot and killed in the hallway outside their apartment. Pass, who had frequently complained about noise from Delille’s home, fled the scene and was killed by police after a three-day manhunt.
Delille said she repeatedly told building management about her concerns regarding Pass’ behavior but received no meaningful response.
“Security came and said the neighbor complained about noise, and I said nobody is here, what are you talking about? And then he’s like, 'Be careful with the man downstairs. He’s crazy',” Delille said.
Her attorney, Adam Konta, a partner at Konta, Georges & Buza P.C., said the lawsuit aims to hold the management accountable for what he described as preventable deaths. The suit up to 100 lawsuits against building management regarding living conditions.
“They didn’t do X, and then Y happened,” Konta said. “They could have provided basic safety. They could have removed Jason Pass from the building.”
The building owners did not respond to a request for comment.
