The popular radio host, whose real name is Jean Paul Guerrero, was killed by a car in December 2016 after he finished playing at a party in East New York.
Kevin Ozaria was out on bail and was expected to be sentenced to five years’ probation and 100 hours of community service.
However, his lawyer says his client was charged with sex abuse in the first degree. He says the charge is based on allegations made by Ozaria's own niece. His lawyer claims there's a family dispute behind the alleged crime.
A judge will begin to address the sex abuse allegations on May 13 and possibly revisit his sentencing on May 15.
