A trial date has been set for a high-profile police shooting that happened inside the Sutter Avenue subway station in 2024.
Derell Mickles is scheduled to stand trial on June 3, more than a year and a half after police shot him nine times at the Sutter Avenue station on Sept. 15, 2024.
Prosecutors charged Mickles with eight counts, including attempted aggravated assault on a police officer, menacing a police officer and criminal possession of a weapon.
Surveillance video and police body camera footage from that day show Mickles entering the station twice without paying and, at one point, holding a pocketknife.
Authorities say Officers Edmund Mays and Alex Wong approached Mickles on the platform and repeatedly ordered him to drop the knife. When he did not comply, officers used a Taser before they opened fire, striking him nine times.
Two bystanders were caught in the gunfire. One of them, Gregory Delpeche, was shot in the head.
Delpeche’s family has filed a lawsuit against the city seeking $80 million in damages. The suit alleges he suffered a traumatic brain injury that left him partially paralyzed and caused lasting cognitive and neurological damage.
In a statement to News 12, the family’s attorney said Delpeche “continues to suffer severe and life-long injuries” but is working toward recovery.
An internal investigation into the shooting was conducted, but both officers remain on the force.
A small group of activists gathered outside the Brooklyn district attorney’s office on Wednesday, calling for accountability in the case.
Mickles is being held on $200,000 cash bail at Rikers Island as he awaits trial.
